There Could Be Fines or Open Investigations
Video Transcribed: What are the notification requirements if a dispensary fills the secret shopper’s product test? I am Tulsa medical marijuana business attorney Ope Adegbuyi.
The authority that’s the OMMA shall implement rules to notify any licensed medical marijuana dispensary, and licensed medical marijuana grower, or licensed medical marijuana processor of any investigative results determined to be non-compliant.
After the licensed medical marijuana dispensary and the licensed medical marijuana grower, or the licensed medical marijuana processor is notified of the investigative results, such results may be used by the authority to take action against the licensee. Assess fines, or assess other civil penalties available to the authority.
The authority shall implement rules on sharing such investigative results with any other law enforcement agencies, or regulatory authorities. The authority may elect to conduct further evaluations on the investigative results at any time for verification or for other properties reasonably related to sanitation, public health, or public safety.
So basically, if the dispensary fails the testing carried out by the secret shopper, then they’ll be notified, and then they might assess any fines or open any investigations if need be.
