How can I get information about a trust my parents set up? How do I find out who the trustee is? How do I know what rights I have in a trust?
Trustee Information
These are very frustrating questions, and they’re difficult to answer as an attorney because the truth is, you may not be able to know any of those things.
A trustee who is part of a trust should know that they’re the trustee. They should be informed. The person who has access to that individual’s will, deposit box, fireproof box, or personal records should be able to locate that trust and communicate its contents.
Verification of Trust
If you come across a trust document and don’t know whether it’s real or not, you need to contact an attorney. You’ll need to see if any assets were placed in that trust, determine who the trustee is, and verify its validity. These are all steps to ensure that a trust comes to fruition.
Sometimes a person may say they have a trust, but they never funded it. They didn’t put assets into the trust. When it comes time to pay bills or manage assets, the trust will have problems unless a pour-over will was issued after their passing to fund that trust.
