As a Medical Marijuana Patient You Cannot, Sell Medical Marijuana to Any Other Patient or Any Business or Any Other Person

So I’ve come across a lot of medical marijuana patient license holders, who are under the impression that they can either, A, sell Oklahoma medical marijuana or their Oklahoma cannabis that they’re cultivating under their patient license, or B, cultivating medical marijuana at another location, other than the location for which they’re licensed to, other than the location that they put on their actual application.
Those two things are huge no-no. So number one, the medical marijuana authority rules and the statute both list out that, A, you cannot, as a medical marijuana patient, sell medical marijuana to any other patient or any business or any other person.
Period. All stop. You can’t do it. You’d be looking at a regulatory fine, and also to potentially having some criminal implications as well, because you’re operating outside of your capacity as a Oklahoma medical marijuana patient.
Now with that, as your first offense for doing that, the statute specifically states that you cannot be charged with a crime. However, you are looking at that regulatory fine. A regulatory fine is 200 bucks. Again, for your second offense, no criminal prosecution, but a regulatory fine of $500.
And then after that, the statute only explicitly states for the first and second time that you’re not going to be able to be charged with a crime. I don’t know what happens at the third point or at the third offense. The statute is silent on that. Also the statute is silent on whether or not each instance of selling to an individual is an offense, or if they’re all cumulative. Those things have to be actually panned out in court.
Secondly, when it comes to where you cultivate medical marijuana as a patient, the rules specifically state that you can only cultivate medical marijuana. So your six plants are your six seedlings and your six mature plants. You can only cultivate those at the address that you actually have registered on your medical marijuana patient license.
So you can’t grow it in your girlfriend’s house or your friend’s apartment or your grandparents’ 20 acres or anything like that. You have to grow that marijuana at the address that you used to register with your patient license. That’s it guys have a good day.
