And this video is going to be all about whether or not you’re required to open up your business for inspection from OMMA inspectors. And the short answer to that is yes, definitely. You are required to open up your business for inspection.
Actually, one of the items that’s baked into you filing for a cannabis business license is your consent to the Oklahoma Medical Marijuana Authority coming out and inspecting your business, and also your consent to following all of Oklahoma Medical Marijuana Authority rules, one of those rules also being that they’re going to come out and inspect your business, possibly up to two times annually.
So you are actually required to open up your business. You cannot stop them at the front gate or stop them at the door. You’ve already given your consent just by submitting an application to OMMA inspecting your business.
So the question becomes what happens if you are not at your business location when they want to come out and inspect? Well, they will definitely reach out to you and schedule you another date that they’re going to come out and they’re going to inspect.
I would highly recommend that you get this done and resolved the first time around. Don’t try to skirt around the state. If you are operating your business lawfully, even if you have some questions, but you’ve been doing your due diligence and you’ve been trying to do things right, you generally don’t have anything to hide.
I’ve been generally classifying these inspections almost as a courtesy that the state is extending out where the state essentially says, “Hey, this is where you’re operating. This is where you need to operate under Oklahoma Medical Marijuana Authority rules. Can you please bridge the gap?” So don’t panic if you receive a notice of inspection.
The inspectors are generally good people. So just don’t panic. If you want to have an attorney present while your business is being inspected, you have that right as well. And just as I spoke in another video, you also have the right to object to any violations that have been assessed on your business.
