Possession of Cannabis Products After License Expiry: Legal Implications
Hello, this is Oklahoma Cannabis Business Attorney Jesse Kovach with the OK Cannabis Law Office. Today, we’re going to be asking, am I allowed to still possess marijuana products after my license expires but before my renewal window is closed? The answer to that question is no. After your license expires, you’re not supposed to possess, sell, transfer, or do anything with any marijuana product at all until you get that renewal application turned in.
Now, the old rules, the old laws, just simply said that you’re not allowed to do this. Going into effect, Senate Bill 1939, going into effect November 1st, 2024, says that, clarifies that you can be liable for felony prosecution if you continue to sale, possess, transfer, or otherwise use marijuana products while your license is expired. So, it’s extremely important to get that renewal application sent in before your license expires and if you don’t get it in on time, you need to immediately waste the product that you have on hand and do everything that you need to do to make sure that you do not have any controlled dangerous substances.
Consequences of Possessing Cannabis Products After License Expiration
It is crucial to adhere to the regulations surrounding cannabis licensing to avoid legal troubles and potential felony charges. Failure to comply with the laws can result in severe consequences, and it’s important to prioritize renewing your license promptly to continue operating legally within the industry.
If you find yourself in a situation where your license has expired, it is recommended to take immediate action to rectify the situation and dispose of any cannabis products in your possession. By following the proper procedures and regulations, you can avoid legal complications and ensure compliance with the law.
