Growers Using Wells: How SB 133 Will Restrict Your Groundwater Use
Hey, Oklahoma medical marijuana business owners. Those of you who are using groundwater, like wells, or are in rural counties that have groundwater rights—this bill, Senate Bill 133, is going to require businesses that have an OMMA license to submit that license to the Oklahoma Water Resources Board in order to use that water for their grow. This is an overextension. This is not something that is normal. It is not something that I expected to see. This would create violations if you didn’t submit it to the Oklahoma Rural Water Board. It could also create other issues with the Oklahoma Water Board because this usually involves water usage and EPA-type rules. This rule could spiral into some other challenges. Right now, it is just a submittal requirement, but the approval or acknowledgment process—and how it’s documented—is still left up in the air, which is, of course, never fun for any OMMA business.
