Senate Bill 786 and Regulations on Medical Marijuana

OMMA has been silent on open containers, but our state legislature is not staying silent on this matter. Senate Bill 786 is in front of the House, and it’s creating secondhand smoke regulations—so, no smoking in the car—as well as open container laws that may apply to criminal trafficking or criminal charges for owning medical marijuana, especially if you have a vape pen or some other cannabis item in your purse or in your car for medication going forward.
Implications for Dispensaries and Patients
If this bill passes, dispensaries need to be aware of how they’re selling this product to their patients—telling them the risks of opening this product prior to getting home and keeping this product available to them in the car.
