Senate Bill 1039 Impact on Oklahoma Medical Marijuana Licenses

Currently, Senate Bill 1039 is going to affect how you apply for your licenses. OMMA’s process has always included lots of rejections, updates, or other information causing multiple passes. This law is designed to remove the multiple passes and to allow rejection after resubmittal of the same information.
Understanding Senate Bill 1039 Changes
It’s worded to apply if information is resubmitted more than once on a material deficiency or recurring clerical error. So, something like a name change, an operating agreement, or a material deficiency like an OSBI check being outdated—those types of things would be considered a material deficiency, and that would cause the submission to be removed and you would lose the application fee.
I can see this being applied to a lot of grows, dispensaries, and processors that have certificate of occupancy issues and fire marshal issues already pending with OB&DD, but the fire marshal is so far behind. I can also see this being an issue with transfers and other processes that are moving slowly, as OMMA has been nitpicky—to use any term available.
