Signage Requirements

Today, we’re going to be talking about what are the signage requirements that must be met by a commercial grower in Oklahoma. Now, as you may or may not have seen, OMMA has recently started tapering down on this. Just about a year after these rules went into effect, last November in 2022, OMMA has now issued about 165 petitions to revoke licensees for failure to meet these requirements. So, this is a big deal.
Now, as the statute says, what basically you need is an 18 by 24 inch sign that has a white background, plain black text, and a readable font that is posted at the site of your operation but at the perimeter of your property such that it’s visible from the road. Now, that has already caused some issues with some of our clients. We have clients who have put these signs on the building or the area where the grow operation is actually happening, but unfortunately, it’s not perfectly seen from the road and OMMA told them that’s a problem. That’s a violation. We’re going to revoke your license.
Now, that’s a decision that we’re going to fight because we think it’s a little ridiculous to try and revoke someone’s license for not having a sign 50 feet in the right direction. But, as you well know, the best thing to do to protect your interests is to play their game and do everything that you can to get on the right side of their regulations. So, again, you’re going to need an 18 by 24 inch sign. The text on that sign needs to be at least two inches in size.
Important Information for Signage
For the information that you need, you need to show your business name, the physical address associated with your license, the phone number associated with your license, your OMMA license number, and also your OBN registration number, which is another new requirement that just came through in August of 2023. So, you’re going to need all those things posted on signage as easily seen at the perimeter of your property.
Usually, you have a time frame of about 60 days after your renewal is granted for you to fulfill these signage requirements. Otherwise, after that, it says that your license will be immediately revoked. So, it’s very important to stay on top of this. And another thing to keep in mind is there might be other local city ordinances or other jurisdictions in your area that control sign requirements, and those need to be met as well. But first and foremost, you want to get those five pieces of information, name, address, location, OMMA license number, and OBN registration number on that sign with meeting all their requirements as soon as possible.
