Setting Limits, Not Banning Businesses
Video Transcribed: What powers do the city or state have on recreational marijuana businesses? I am Oklahoma Medical Marijuana Business Attorney Ope Adegbuyi.
According to State Question 820, cities or states cannot ban or limit the number of adult-use businesses in their jurisdictions but will be allowed to regulate the time, place, and manner of operations of adult-use businesses, as long as those regulations are not unduly burdensome.
They can’t regulate how much marijuana a business can have. They can’t stop businesses from opening marijuana dispensaries, growers, or whatever, but they can regulate where, what location, what time, or what place the business can operate. Even with those regulations, they cannot be burdensome to the business owner or the business.
