Understanding Oklahoma Senate Bill 1635
Hello, this is Oklahoma Cannabis Business Attorney Jesse Kovacs with the OK Cannabis Law Office. Today we’re going to be talking about what is going on with Oklahoma Senate Bill 1635. Now this bill is very relevant for those of you out there dealing with Certificate of Occupancy issues, which I know there are a lot.
Implications of the Bill
Basically what is going on right now is that the Oklahoma Legislature is trying to pass a bill, an act, that would essentially act as a reset for the COO issue. And I’ll just tell you from the bill itself what it would do. It says that all existing medical marijuana business licensees that do not possess a valid Certificate of Occupancy where required shall be subject to revocation until such time that is obtained.
But this provision shall not apply to medical marijuana business licensees who submitted a full and complete application for a valid COO to the state fire marshal or your local authority having jurisdiction before November 1st, 2024. So essentially we’re going to have until November to submit that full and complete application for a COO to the fire marshal or to your local authority having jurisdiction.
Current Status and Next Steps
To be clear, this bill is not all the way through. The legislature has not been signed into law yet. It has been passed by the Senate and now an amendment to it has been passed by the House to be sent back to the Senate for further approval. So we’ll see this process play out over the next few weeks and months or so.
But the upshot appears to be that eventually the legislature of Oklahoma is trying to do a giant reset on the COO issue, which should hopefully take a lot of stress and obligations off of the licensees out there.
