Understanding OK SB 645: Packaging Requirements for Medical Marijuana Products
New Packaging Requirements
What does SB-645 require? I am Oklahoma medical marijuana business attorney Ope Adegbuyi. SB-645 requires that any medical marijuana flower, trim, shake, keef, medical marijuana product, or other flower-based product not defined as a concentrate sold by licensed medical marijuana processors and growers to licensed dispensaries must be in prepackaged form, weighing at least half a gram and no more than 3 ounces.
Medical marijuana flowers may be packaged in a non-opaque material if all required labels are displayed on it and it is placed in an opaque container before leaving the licensed medical marijuana dispensary. So in short, this means that processors and growers are responsible for weighing out the products before selling it to licensed dispensaries and dispensaries are responsible for repackaging flowers into a solid non-translucent package at the point of sale.
Implications for Dispensaries and Growers
So that means all the products that the dispensaries are going to be selling now must be in packages and cannot be more than 3 ounces and not less than half a gram. So in this situation, dispensaries would have to know what their customers want and how to package if they’re going to do like, you know, multiple gram packages or multiple 3-ounce packages just to meet the needs of their clients.
This bill is going to be in effect on November 1st, 2023. So that’s something that dispensaries and growers and processors will have to start doing by then.
