Navigating Business Raids: Your Rights and Actions
Hello, this is Oklahoma Cannabis Business Attorney Jesse Kovacs with the OK Cannabis Law Office. Today, we’re going to be asking, what do I do if and when my business gets raided by OMMA or OBN or another law enforcement agency? And the answer to that question is pretty simple. It’s be silent. Don’t talk. Be cooperative. Don’t be uncooperative.
Don’t cause problems. But realize that this is just like any other issue where you’re dealing with law enforcement, where you have the right to remain silent and not offer evidence against yourself. So essentially, what I would do is be silent, be cooperative, document as much as you possibly can.
Key Steps to Take
If you can take video of the happenings that are going on, I would take video. If you can document when the agents arrived on scene, when they left on scene, who was involved, the names of the agents and the names of the agencies involved. Get as much documentation of what’s going on as you possibly can, while at the same time not offering up any additional evidence that could be used against you.
