Understanding House Bill 3361
Hello, this is Oklahoma Cannabis Business Attorney Jesse Kovacs with the OK Cannabis Law Office. And today we’re going to be talking about the new package requirements imposed by House Bill 3361. Now, if you haven’t seen, there’s a new act that has just made it through the Oklahoma Legislature. It essentially creates more specified requirements on the packaging of marijuana product that is sent from growers and processors to dispensaries.
Key Provisions of the Act
And what it essentially says is that all products that are not marked as concentrate, so that means flour, trim, shake, keef, any medical marijuana product or flour product that is not defined as concentrate, must be delivered in prepackaged form and package sizes weighing no less than half a gram and no more than three ounces. The other thing that this act does is it directs OMMA to create rules and regulations that would allow patients to return product that they bought that is either defective or hazardous to the patient’s health.
It also provides or directs OMMA to create rules for dispensaries to return defective and hazardous product to the processors and grows from which they purchased it.
