If A State Agency Issues Out New Rules, They’re Required To Issue Out A Notice
Video Transcribed: Oklahoma attorney Isaiah Brydie coming at you with another video. And with this video, I wanted to let you guys to know that it looks like there are going to be some new rules that are going to be handed down from the Medical Marijuana Authority. With that, those new rules are going to go into their noticing comic phase on February 3rd, And that’s going to follow all the way until March 7th.
Now, in this phase, this is a really, really important phase. So, per statute, whenever a state agency issues out new rules, they’re required to issue out a notice and comment phase. Now with that, that phase is supposed to be there, so that the general public can issue in their notices and their comments about how the new rules are going to impact them, what their opinions are, what some proposed changes may be. And also, too, with the statute in place, the governing, the State Agency, is supposed to actually go in and review those comments, and actually take into consideration those comments that were given by the general populace.
So, if you read the new proposed rules, and you give out your comment, those comments have to actually be read and considered by the State Agency. They don’t have to be adopted. They may be adopted, but they must be considered. So, I’ll be going through these new proposed rules. I may even issue out my own comment in my individual capacity. Also, too, some of my clients who want me to, may also have me issue or draft a comment for them as well.
With that being said, we want to make sure that we’re taking an active role in how this industry is developing. And of course, we can’t do that by only knocking our heads up against the wall and complaining, or anything like that. We have to take an active position in policy making.
So, with that, I would appeal to you guys that we should get really active on issuing our notices and our comments on these proposed rules after we review them. Let’s take a proactive approach to this, and make sure that the industry can be heard. Because those people and those individuals who are against the industry, they’re definitely making themselves heard. So we need to make sure that we have the louder blow horn in this situation.
