File a Name Early to Ensure You Can Have Rights to It.
Video Transcribed: What is the second step in creating a business in Oklahoma? I am a medical marijuana business lawyer in Tulsa, Oklahoma. My name is Ope Adegbuyi.
We’re continuing our discussion on how to create a business in Oklahoma. The second step entails choosing your business name. So when you’re filing your articles of organization, if you’re an LLC or you’re filing a certificate if you’re a corporation with the Secretary of State, then you would have to choose your business name. There’s an option on the Secretary of State’s website where it would tell you to put the name you want. If the name is taken, it would bring out a list of names that are similar to the name that you’ve chosen. If there’s nothing similar to your name, then it’s likely that the Secretary of State will approve your name choice.
If there’s a similar corporation that has your name, for example, if you want it to be called J and J Corp and there’s also a J. J Corp, they might not approve your name choice. So you have to choose names that are not similar to other names. And then if you have chosen your name and you wanted to do business under a different name, for example, if you chose the name of J and J Corp, but you wanted to go by J and J LLC as your trade name, then you would have to file an additional trade name report with the Secretary of State, and you put your legal name, which would be the J and J Corp, and then the name you’re trying to do business as, which will be the J and J LLC as your trade name, and then file that document. Then you’ll be able to trade names under that name.
