Today we’re going to talk about my application has been rejected. There’s a lot of that going on right now. I’m getting a lot of calls that people’s applications have been rejected. There’s a host of reasons your application could be rejected.
It’s not the end of the world if your application is rejected. Just means you got to fix the problem and resubmit it. You do not have to pay any more fees once it’s been rejected. Sometimes they are rejected, sometimes they aren’t.
So some of the most common reasons that they’re rejected are your affidavit of lawful presence for all owners. There needs to be one for all owners. They must be signed. The attestation box must be checked. If you are a resident alien, then you need to fill out that section as well.
Another reason your application could be rejected is that you submitted your driver’s license picture in black and white or you didn’t submit it at all. You have to upload a color copy of all owner’s driver’s license. They have to be uploaded individually.
You have to put the name of that person in a specific box when you’re doing it. And you have to also upload a copy of the back of your driver’s license. When you save them on your computer before you upload them, you need to put the person’s name on that back and on that front as the identifying descriptor.
One of the more recent rejections is because people don’t understand what an operating agreement is or they don’t understand a business plan. Not everybody needs a business plan. If your business is an incorporation or a company, it’s not an LLC, you’re going to need a business plan to submit. If you’re an LLC, then you have to have an operating agreement.
And just having the operating agreement’s not enough. It must be signed by all owners. Whoever owns a piece of that business must sign that operating agreement. It should tell everybody’s interest and if they put any money in, it needs to have that information as well. So that’s a big one.
We’ve noticed lately we’re getting back certificates of compliances that are not signed. We don’t know if people just don’t understand that they must take that certificate of compliance to their city or their county, whoever handles the certificate of compliance for your locality. And that must be signed by someone in that department. However, that community or that locality handles this.
Now, a lot of them are doing … Not a lot, but if your business is located in a rural area, then you have to go and talk to the people involved with that. Most rural areas, most counties, they just give you a letter. You still need to attach the certificate of compliance, even though it’s not signed with that letter.
And you must have the business information filled out. There won’t be any signatures because the letter is going to take and cover that signature. But it must all be together. If you just submit the letter, it’s not good enough. They will reject you.
Also for renewals, your certificate of good standing, you have to get a new one every year and upload that. If your certificate of good standing is more than a year old, they will not accept it so. What you do is when you get that rejection, you read what the issues are, you go in and you fix those issues, upload the correct documents. Also, this is a big one, residency documents.
You have to provide residency documents for every Oklahoma resident that is an owner in that business. They will accept an expired driver’s license front and back as we were just talking about. They will accept a driver’s license that’s more than two-years-old front and back. They will accept tax documents and they will not accept federal tax documents. They will accept only Oklahoma state taxes.
So you would have to provide that and it has to be for two years, two consecutive years. And those two consecutive years must be the two preceding years of when you’re making the application. So for this year, it’s 2019 and 2018.
After April of next year, it’ll be 2020 and 2019. So you see how that goes. Now, if you are saying that, “Well, I’ve lived in Oklahoma for five consecutive years out of 25 years,” you need to provide your tax returns or some kind of documentation. And if you were in school, I believe your school transcripts would work.
So they have a concise list of what they will and will not accept. If it’s not on the list, they will not accept it. All right. But anyway, if you get a rejection, just fix the problem. They tell you at the top everything at the one, two, three, four, five however many problems there are.
We’ve seen as many as nine. Yes. we’ve seen as many as nine that people have come to us and asked us to help them fix the problems. So needless to say, just fix the problems, hit save, next, and go to the next, review and then submit.
Well, that will submit your application. And what we are seeing at this time, we don’t know what it will be in the future. It’s taking about two weeks once you resubmit your rejected application for them to give you an approval or another rejection.
Usually, it’s just an approval, but I’ve seen multiple rejections lately because it just depends on who is handling your account. So if you have any problems, give us a call at (918) 932-2879 to for a low-cost consultation with a Tulsa medical marijuana attorney.
